The G.A.B. staff has received several communications from clerks and citizen groups concerning the circulation of petitions at polling places.  Due to the anticipated presence of petition circulators at polling places for the upcoming Spring Election on April 1, 2014, the G.A.B. wishes to reemphasize advice originally provided to election officials, voters and recall petition circulators in March 2011. 

The March 2011 memorandum is attached above.

For the upcoming Spring Election, clerks have received notice from groups planning to circulate petitions regarding an amendment to the U.S. Constitution.  The G.A.B. believes the circulation of petitions regarding an amendment to the U.S. Constitution is permissible because it would be unrelated to candidates, contests or referenda issues on the Spring Election ballot; therefore the analysis used to issue guidance on the circulation of recall petitions is also applicable here.
