Several clerks have contacted our office regarding a request that is being sent to Wisconsin municipalities seeking information about voting equipment memory devices and the data that may be available from those devices.  As we have previously indicated, we cannot provide legal advice regarding compliance with the Public Records Law, and we encourage clerks to consult with their municipal attorneys in responding to records request.  It may be helpful, however, to review the information we circulated in 2012 pertaining to requests for memory device data.

The memorandum we circulated and accompanying correspondence from the Department of Justice are attached.  Please share this information with your legal counsel and seek his or her advice relative to public records requests.
